ARTICLE: ADJUDICATIVE JUSTICE IN A DIVERSE MASS SOCIETY: "This Article 2 addresses problems created by the disparity in access to the courts and other adjudicative fora between the privileged and less privileged. 3 Enormous efforts have been made by the legal profession to equalize opportunities to enforce substantive rights. 4 These efforts have fallen short of what we can and should accomplish.

I. Equalizing the Adversary System

It may be argued that our adversary, adjudicative system should take each case as presented and weigh it without regard to the background"

Family Courts Muddying the Health Care Quagmire in New York State | Fearless Fathers

Family Courts Muddying the Health Care Quagmire in New York State | Fearless Fathers: "With my employer, I have comprehensive health insurance that covers dental and vision expenses for the family. Accessorily I am complying with New York State law, which mandated via medical support order (New York State Civil Practice Law and Rules 5241) that I take health insurance for my children. But  ex-wife does not want to use my health insurance, threatens the health providers to take her business elsewhere if they bill me instead of her and fill insurance forms. Twice a year on average, she takes me to court for unreimbursed medical expenses that could be reimbursed by my insurance. So far, Manhattan family court’s ruling has taken latitude in its interpretation of  New York State law: I have to provide an insurance for my kids but ex-wife can use it only if she pleases. The outcome is the wildest dream come through for the Republicans and private health insurance companies: a mandate to have insurance and a legal denial of benefits. No “medical losses” in insurance companies terminology. 100 % profits."

Fathers Rights in Custody Battles

Fathers Rights in Custody Battles: "Although most attorneys are trained to negotiate settlements out of court (and that makes good sense in most cases), when dealing with an unreasonable spouse, negotiating may not be a good first approach. Unfortunately, in many of these difficult cases, the "hammer" approach may get more results and may actually pave the way for negotiations later.

Find an attorney who is not only skilled in custody disputes but someone in whom you have confidence. There is no need to work with someone you do not believe can do the job. Because custody battles can be nasty, lengthy and stressful, many attorneys may give more attention to their "easier" files. You will need to work with someone who can give your file the attention it deserves no matter what.
There is much to know about the fathers rights and getting help with coping custody battles. The good news is that there is considerable information about the divorcing process and lots of available divorce an custody resources. The important thing is to find reliable divorce information and resources. Using the divorce resources on the Internet is a good starting point."

Types of Child Custody and Visitation

Types of Child Custody and Visitation: "Sole Physical Custody: With this type of child custody, the child physically resides at one location. In most cases, the non-custodial parent is awarded generous visitation rights, including sleepovers.

Joint Physical Custody: This form of child custody is also called "Shared Custody," "Shared Parenting," or "Dual Residence." In this situation, the child/ren live with one parent for part of the week (or part of the year), and live with the other parent during the remaining time. The division of time spent at each location is approximately equal.

Bird's Nest Custody: This is when the children live in one central location, and the parents rotate in and out of the children's home on a regular schedule. For example, mom may reside at the children's home Monday evening through Thursday, and Dad may reside there from Thursday evening through Monday morning.

Visitation

Parent-child visitation allows parents who do not have physical custody to see their children on a regular basis. Types of visitation include:

Unsupervised Visitation: This is the most common type of visitation. Parents with unsupervised visitation are generally permitted to take their children to their own homes or may enjoy an outing child their children during their scheduled visitation. Sometimes limitations are be placed on unsupervised visitation; for example, a non-custodial parent may be asked to visit his infant child at the mother's home until the child is accustomed to taking a bottle."

How to Conduct a Successful Coparenting Meeting With Your Ex

How to Conduct a Successful Coparenting Meeting With Your Ex: "5. Stay Focused on the Kids During Your Coparenting Meeting
The purpose of your coparenting meetings is to work together in raising your children, which is not going to happen unless you make the effort to communicate effectively with one another. Therefore, each of you must make a conscious decision to stay focused on the kids during these meetings. It's not the time for personal discussions or rehashing conflicts in your relationship. If you need to schedule time for those kinds of discussions, do it separate from your regular coparenting meeting. Also, try to set a time limit for your meetings, such as 30 minutes."

How to Conduct a Successful Coparenting Meeting With Your Ex

How to Conduct a Successful Coparenting Meeting With Your Ex: "2. Meet Weekly
Be committed to meeting on a consistent basis, such as weekly. This will convey the message to your children that - when it comes to raising them - you are indeed a united front. Yes, this will be extremely difficult in the early stages of your divorce or separation. However, keep your focus centered on your common goals - the children - and the meetings will get easier with time.
3. Communicate Through the Phone and E-mail
You do not have to meet in person! In many cases, talking on the phone or using email is preferable. That's okay as long as you are committed to communicating with one another using whatever medium is most productive for the two of you.

4. Use an Agenda During Your Coparenting Meeting
There are certain topics - such as schedules, school progress, and behavioral concerns - that you're going to want to cover each week in your meetings. You can simplify your discussions by using a printed agenda. Create a standard form to include all the topics you wish to discuss regularly, and complete it prior to your meeting"

Win Child Custody - Proper Courtroom Etiquette Can Help You Win Child Custody

Win Child Custody - Proper Courtroom Etiquette Can Help You Win Child Custody: "motional Outbursts

Avoid all emotional outbursts. Emotional outbursts upset the judge and might give the child's other parent an advantage. Understandably, determining custody of a child is an emotional event. However, a parent who becomes overly emotional may give the judge a bad impression. As a result, after an emotional outburst, the child's other parent may have an advantage and even win child custody.

Asking and Answering Questions

A parent who would like to interject an opinion or ask a question during a child custody hearing should first speak with their attorney. The attorney is the only party, aside from the judge, that may speak at all times during a hearing. An attorney can ask a parent's question or ask for clarification at the most appropriate time."

Documents to Help You Win Child Custody: "Visitation Schedule

In addition to phone call logs, parents should keep a log of visitation between the child and the child's non-custodial parent. A visitation schedule log should include the following:

When the visits occur
Where the visits occur
How long the visits last
Frequency of visits (daily, weekly, bi-weekly)
A non-custodial parent may utilize this information in court to prove a continuous and meaningful relationship with the child, while a custodial parent might use a log of visitation schedules to prove the lack of a continuous relationship between the child and the child's non-custodial parent.

In fact I am a lucky man, and the bureaucrat from New York State Child Support Processing Center in Albany who deals with my case a sensitive fellow indeed.

Let see. You are the average fellow whose income and payroll taxes amount to 30% of your gross income. New York State garnishes another  65% of your gross income. You are left with 5 cent out of each dollar you earn. If you are taxed more than 30%, you are left with literally nothing."

Even if a court doesn't award you legal custody--that is, with decision-making authority with regard to your child--or physical custody, you still have rights. The judge can still award you whatever visitation your condition makes possible. Furthermore, you would typically receive frequent telephone contact, the right to attend school functions, and access to your child's school and medical records. Even if your condition makes it hard for you to win custody of your child, you can still typically play a major and positive role in his life, regardless of your disability."

It seems that there is always some For Profit Company effectively operating as middleman between the person who really needs the cash to open a retail business and the "supposedly free flowing money" available to help bolster a failing company using money from US federal or state sources!

This needs to be changed, because generally these companies take advantage of the "would be entrepreneur" only hurting him financially by taking his money, rather than helping him.

Memorial Day

Memorial Day: "The first state to officially recognize the holiday was New York in 1873. By 1890 it was recognized by all of the northern states. The South refused to acknowledge the day, honoring their dead on separate days until after World War I (when the holiday changed from honoring just those who died fighting in the Civil War to honoring Americans who died fighting in any war).

It is now celebrated in almost every state on the last Monday in May with Congressional passage of the National Holiday Act of 1971 (P.L. 90 – 363). This helped ensure a three day weekend for Federal holidays, though several southern states have an additional separate day for honoring the Confederate war dead: "

The message to policymakers is that if all countries, rich and poor alike, do not act quickly and cooperatively, the hard-won global progress against hunger and extreme poverty of the past few decades could be rapidly undone.

More specifically, climate change threatens global food security by causing declining crop yields; disruptions in food access, utilization, and price stability; and significantly reduced access to water, food security, and agricultural incomes in rural communities."

We must sincerely thank these scientists for their hugely important contribution to our collective understanding about climate change, and the risks it presents, but we are now on our own. This is it. Our collective fate is on our own hands and we must move forward with urgency and clarity of purpose.

Obstacles remain in the road ahead – most notably, vested interests, blinkered ideology and political short-termism – but the IPCC has made it abundantly clear that the lack of available time means we must press on regardless and secure the rapid transition away from polluting fossil fuels and towards low-carbon, sustainable sources of energy. IPCC: 30 years to climate calamity if we carry on blowing the carbon budget | Environment | The Guardian

IPCC: 30 years to climate calamity if we carry on blowing the carbon budget | Environment | The Guardian: "he report was its "carbon budget". Participants told the Guardian this was the last part of the summary to be decided, and the subject of hours of heated discussions in the early hours of Friday morning. Some countries were concerned that including the numbers would have political repercussions.

The scientists found that to hold warming to 2C, total emissions cannot exceed 1,000 gigatons of carbon. Yet by 2011, more than half of that total "allowance" – 531 gigatons – had already been emitted.

To ensure the budget is not exceeded, governments and businesses may have to leave valuable fossil fuel reserves unexploited. "There's a finite amount of carbon you can burn if you don't want to go over 2C," Stocker told the Guardian. "That implies if there is more than that [in fossil fuel reserves], that you leave some of that carbon in the ground.""

History of Empire State Development

History of Empire State Development

"In 2007, an Upstate ESD headquarters opened in Buffalo in recognition of the different economic challenges posed in the two parts of the State.

Two chairs were appointed, one for ESDC Downstate and the other for ESDC Upstate. The ESDC board also authorized the creation of a subsidiary, Upstate Empire State Development Corporation, to concentrate on Upstate issues."

In 2008, Governor David A. Paterson brought the two components of ESDC back together again,

emphasizing that New York is truly “One State.”  The former Upstate and Downstate offices now work together seamlessly to ensure that New York’s economic development strategy benefits the entire State while being mindful of the specific resources and special challenges of each region.

In January 2011, Governor Andrew M. Cuomo appointed Kenneth Adams

as ESD President & CEO and DED Commissioner. Mr. Adams was confirmed by the Legislature on April 5, 2011

In May 2011, Governor Andrew M. Cuomo appointed

Julie Shimer

as Chair of ESD. She was confirmed by the New York State Senate in June 2011.

History of Empire State Development

History of Empire State Development

"In 1995, in an effort to reduce the size of government and improve efficiency,

the functions of the Department of Economic Development (DED) and the UDC were consolidated, along with other State economic development entities:

The Job Development Authority           (JDA)

Science and Technology Foundation     (STF).

UDC’s directors, reflecting the statewide scope of the Corporation’s current efforts, decided that the corporation would do business as the Empire State Development Corporation (ESDC)."

History of Empire State Development

History of Empire State Development:

"The Corporation can also exercise powers of condemnation, act as an agent in obtaining federal subsidies and grants for projects and invest in real estate at below-market interest rates in a manner similar to that of an individual development agency.

The Corporation’s ability to execute complex financial transactions, coordinate public and private resources and serve as a one-stop development authority thus offers a combination of services that no other private or public service entity in New York State can provide.

In 1975, the Corporation was reorganized and its mission expanded from developing housing to economic development.

The Corporation still maintains a housing portfolio that currently includes mortgages valued at $650 million covering 20,200 housing units."

The Anatomy of Child Welfare Fraud: Part 1 - Targeted Case Management - YouTube:

This government wants to take fathers out of the picture, away from their children, and out of the same house as their kid's (one of them has to leave the home).  They literally lure mothers with cash and a home anywhere they want to go, I guess if you chose a mate that bad....the kids had the cards stacked against them from the beginning, but why can't young men make dumb mistakes and still have an equal chance of raising their own children as well?

Credit score killers - Aug. 19, 2013: "Not having a credit card: A growing number of Americans are ditching credit cards as they turn to debit and prepaid cards instead. But while this may keep you safe from debt, it's not going to help your credit score.
Without any credit history, you're typically considered unscoreable, meaning there isn't enough activity on your credit file to calculate a score. This leads many lenders to deem you too risky to take a chance on, said Ulzheimer."

Too big to fail - Wikipedia, the free encyclopedia: "Opponents believe that one of the problems that arises is moral hazard whereby a company that benefits from these protective policies will seek to profit by it, deliberately taking positions (see Asset allocation) that are high-risk high-return, as they are able to leverage these risks based on the policy preference they receive.[9] The term has emerged as prominent in public discourse since the 2007–2010 global financial crisis.[10] Critics see the policy as counterproductive and that large banks or other institutions should be left to fail if their risk management is not effective."

Too big to fail - Wikipedia, the free encyclopedia: "Proponents of this theory believe that some institutions are so important that they should become recipients of beneficial financial and economic policies from governments or central banks.[4] Some economists such as Paul Krugman hold that economies of scale in banks and in other businesses are worth preserving, so long as they are well regulated in proportion to their economic clout, and therefore that "too big to fail" status can be acceptable. The global economic system must also deal with sovereign states being too big to fail.[5][6][7][8]"

Gee, that's how our United States President views things. A politically charged atmosphere where politicians are just practicing rhetorical battles. Perhaps the US just does not have to resources to fight for justice out there in the world anymore. We simply blew all of our money making sure the fat cats, stay fat at all times. Rescuing things that are simply too big to fail. The government is ineffective regardless of the party or it's leaders. Is there a true political solution available for the United States government to utilize, perhaps not at the moment. We just painted ourselves into a corner of ineptitude with years upon years upon years of fruitless mindless action.

What does the United States of America stand for these days? What can we as a nation be proud of?

Stephen C. Sanders
A sign of the times, where are we all headed?

The United States cannot be so divided among our own ranks. It's like we are some scattered nation, a generation without a cause. Usually I am the optimist in the crowd, always seeking the silver lining. Yet what can we here at home do? I am sure there is an answer and a solution, yet today I just do not see it!
